With Japan's deeply rooted cultural beliefs and superstitions, many Japanese avoid living in ‘haunted’ properties with the spirit of the dead that may live inside the house. These properties are considered jiko bukken—haunted and undesirable. This perception often leads to selling or renting these properties at a lower price. However, some investors see this as a financial opportunity, especially if they don't share these superstitions.

On October 8, 2021, the Ministry of Land, Infrastructure, Transport, and Tourism (MLIT) provided guidelines for real estate agents on managing jiko bukken properties based on actual cases and legal precedents.

## What is a Jiko Bukken?

**Properties with suicide or homicide incidents**

Many agents used to treat any death as a jiko bukken, but current MLIT guidance distinguishes cases: suicides and homicides (and other non‑natural deaths) or deaths that produced significant aftereffects are more likely to require disclosure, while ordinary natural deaths or routine accidental deaths are judged case‑by‑case. Whether disclosure is required depends on the facts (contamination, publicity, time elapsed), not on a simple binary rule.

**Properties that require special cleaning**

When a resident's body is discovered after death, special cleaning, including disinfection and deodorisation, is essential, even in cases of natural or accidental death during daily life. This property can still be classified as a jiko bukken.

**Properties with 'psychological defects'**

The legal term is 心理的瑕疵 (shinriteki kashi), often translated 'psychological defect' or 'stigmatised property.' This covers adverse facts that could materially affect a buyer’s or tenant’s decision. Other adverse histories (e.g., cult activity, gang links, environmental nuisances) are handled under different categories in practice; some agents nevertheless treat them as 'jiko bukken,' but the legal assessment varies by the specific facts.

Shinriteki Kashi Bukken are properties that have an unpleasant past, including cult activities. On the other hand, kankyō‑teki kashi bukken (環境的瑕疵) refers to properties in an undesirable environment — e.g., near graveyards, affected by organised‑crime activity, persistent loud noise, or foul odours.

## What does it mean for the owner?

Owners and sellers must disclose information that would materially affect a buyer’s or tenant’s decision. MLIT’s guideline notes that for many rental cases, incidents requiring special cleaning or non‑natural deaths are generally treated as disclosure items for 'roughly three years' (概ね３年), but this is a practical guideline mainly for賃貸 (rental) transactions. For property sales, there is no automatic three‑year cutoff—disclosure depends on whether the fact would still influence a reasonable buyer. Each case must be judged on its facts.

Real‑estate agents must follow the 宅地建物取引業法 and MLIT guidance: they should investigate known facts and not conceal matters that would materially affect a client’s decision. Failure to disclose can lead to civil remedies (rescission, damages) and may trigger administrative oversight or disciplinary measures; the guideline itself is interpretive and will be used in supervision and disputes rather than creating automatic new criminal penalties. Agents are therefore advised to coordinate with owners and document inquiries and disclosures.

There are several ways to determine whether a property is considered jiko bukken. One example would be if the price is too reasonable to be true. When a property in a prime location with below-average prices is relatively new, it could be a jiko bukken. Another example would be if there are no physical defects or traces of the property or if a part of the rooms are renovated. Lastly, some properties may change their names after the incident occurred.
